Terms & Policies
This privacy policy was last revised on October 3, 2024.
Please read this Privacy Policy carefully.
PURPOSE OF THIS POLICY
The purpose of the privacy policy is to inform you how FORMARKIVET (the "Site", "we", "us", or "our") collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from formarkivet.com (the "Site") or otherwise communicate with us regarding the Site (collectively, the "Services"). For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.
We reserve the right to revise and modify these privacy policy guidelines on the processing of personal data. In case of significant changes, we will contact you via email or via a visible notification on our website.
DESCRIPTION OF PROCESSING
FORMARKIVET processes your information for one or more specific purposes and in accordance with the data protection regulations. We process your information if you are a customer with us, a collaborator or partner with us, visit our website or our social media sites and apply for a job with us. The information will generally come directly from you, and we will only process your information for as long as it is necessary for the purpose for which it was collected.
SOCIAL MEDIA
We engage with our customers and potential customers through various social media platforms, including Facebook, Instagram, Pinterest, and LinkedIn. These channels allow us to promote our marketing initiatives and foster meaningful connections. When you interact with us on these platforms—by liking or following our pages, for instance—we may process your personal data, which typically includes your name and email address, along with any purchase information shared in the context of your interaction.
If you reach out to us via social media, we handle your information based on our legitimate interest in responding to your inquiries (as outlined in GDPR Article 6(1)(f)). The data we collect comes directly from you and the social media platform through which you contact us.
We share joint data responsibility with the social media platforms we utilise, as both parties process your data for our respective purposes. For more details on how these platforms handle your personal data, please refer to their privacy policies:
- Facebook and Instagram: Review their processing of personal data in Facebook’s Privacy Policy.
- LinkedIn: Learn about LinkedIn’s data processing in LinkedIn’s Privacy Policy and their joint data responsibility here.
- Pinterest: Check out Pinterest’s handling of personal data in Pinterest’s Privacy Policy and their joint data responsibility here.
Please note that information processed through social media will be deleted alongside the relevant interactions. However, posts made on public Facebook pages or within public groups remain accessible as they are part of public areas. For more information about public areas on social media, please refer to the respective platform guidelines.
By maintaining transparency about our use of social media and your data, we aim to foster trust and ensure a positive experience for all our users.
CHILDREN’S DATA
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
MARKETING
We process your personal data for marketing purposes only if you have provided your consent in accordance with GDPR Article 6(1)(a). This may include receiving newsletters about events, invitations, new products, and interior design inspiration. The extent of our data processing is outlined in the specific consent you provide.
When you subscribe to our newsletter, we collect your name, email address, and any preferences you specify during your subscription. We use this personal data to send you newsletters. If you have interacted with us prior to subscribing (for example, by browsing our website or purchasing products), we may use that information to recommend relevant products to you through our newsletters (profiling).
If you have consented to receive our marketing communications, we typically collect information such as your name, email address, and customer type (e.g., whether you are an architect, designer, dealer, or private individual).
You have the right to withdraw your consent at any time by unsubscribing via email at info@formarkivet.com. Personal data related to our distribution of electronic newsletters will be deleted two years after our last newsletter has been sent unless you have unsubscribed before that time.
JOB APPLICANTS
If you apply for a position with us, we will process your personal data to evaluate your qualifications for current or future roles. The information we handle includes your name, contact details, date of birth, work experience, educational background, and references.
We process your data to establish and fulfil an employment agreement with you (in accordance with GDPR Article 6(1)(b)). Additionally, we may process your data if we determine that our interests in doing so outweigh your interests in not having your personal data processed. This could include information you have shared on social media or data obtained from personality or proficiency assessments (GDPR Article 6(1)(f)).
Should we wish to retain your information beyond the recruitment process, we will seek your consent for this purpose.
RECIPIENTS OF PERSONAL DATA
We handle your personal data with the utmost confidentiality and typically do not share your information with third parties. However, we may disclose your personal data if you have provided your consent or if we have a legitimate interest in doing so.
We may share your personal data with our system providers who process this information on our behalf, following our specific instructions as outlined in the data processing agreements we have established.
Some of our data processors, as well as the social media platforms with which we share joint data responsibility, may be located outside the EU, resulting in a transfer to a third country. If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
YOUR RIGHTS REGARDING PERSONAL DATA
You have specific rights that empower you to control your personal data, and we are committed to making it easy for you to exercise these rights:
- Right to Withdraw Consent: If you have given your consent for us to process your personal data, you have the right to withdraw that consent at any time. You can do this by contacting us (see contact details below). Please note that withdrawing your consent will not affect the legality of any processing carried out prior to your withdrawal.
- Right of Access: You have the right to confirm whether we have collected or processed your personal data. If we have, you can request a copy of your personal data in a digital format.
- Right of Rectification: You have the right to request corrections to any inaccurate personal data we hold about you and to complete any incomplete information.
- Right of Erasure: In certain circumstances, you may request that we erase your personal data, such as when it is no longer necessary for the purposes for which it was originally collected.
- Right to Restrict Processing: You have the right to ask us to restrict the processing of your personal data in certain situations, for example, if you believe that the information is inaccurate or has not been processed lawfully.
- Right to Object to Processing: In specific circumstances, you can request that we stop processing your personal data. This includes the right to object to profiling and direct marketing activities.
- Right to Data Portability: Under certain conditions, you have the right to receive the personal data you have provided us in a structured, commonly used, and machine-readable format. You also have the right to request that we transmit this data to another entity where technically feasible.
